Palais de justice : O. K. Ba et son patron, le rapport sexuel sans consentement, les 25 000 FCFA offerts et le chien Pitbull
Devant le juge, le mis en cause veuf et père de cinq enfants a nié en bloc toutes les accusations de la plaignante voilée d’un hijab de couleur noire. A l’audience a duré plusieurs tours d’horloge et elle a tenu à rappeler le début de l’histoire.
«J’ai travaillé chez lui que 3 jours et c’est au 4ème que les faits se sont produits. Il m’a dans la journée trouvé dans la cuisine en train de préparer le repas et m’a fait part de son souhait de me parler. Je l'ai retrouvé dans le salon où il m’a remis 25000 FCFA et m’a dit qu’il avait besoin de moi durant la nuit. Je ne savais pas de quoi il parlait, j’ai essayé de lui demander pour qu’il soit plus précis, mais il ne m’a rien dit et je lui ai remis la somme d’argent que je ne pouvais prendre sans raison», a confié au juge la victime.
Sur les faits de viol, O. K. Ba est formelle, le sieur Diallo l’a bel et bien contraint à avoir un rapport sexuel sans consentement.
«S. Diallo est venu me retrouver dans ma chambre pour me forcer à avoir un rapport. J’ai refusé et s’en est suivi une altercation. J’ai voulu fuir, mais il y avait son chien de race (Pitbull) qui voulait m’attaquer, j’ai alors couru vers le salon. De là, il m’a suivi une paire de ciseaux à la main. On s’est bagarré avant que l’arme ne tombe. Je suis partie me réfugier dans les toilettes où il m’a encore tiré à l’aide d’un couteau qu’il avait par devers lui avant de me traîner dans sa chambre pour me violer», a soutenu la plaignante qui explique avoir perdu connaissance après les faits.
«Quand Diallo a fini, il est sorti de la chambre et j'ai aussitôt enfilé ma culotte avant de m'enfuir de la maison. Je me suis retrouvée à l’hôpital par la suite», a-t-elle dit.
Interpellé sur les faits de viol et son comportement, O. K. Ba a raconté s’être débattu et s’est finalement laissée faire lorsque sa crise d’asthme a commencé à se manifester.
«Il m’a d’abord doigté avant de me pénétrer. Il n’avait pas mis de préservatif et a éjaculé dans mon vagin», a précisé la jeune dame.
Pour sa part, le prévenu à l’âge avancé dément.
«D’abord, je ne lui ai jamais proposé une quelconque somme pour quoi que ce soit. C’est faux ce qu’elle raconte (…) tout ce problème a commencé le jour où je lui ai dit d’arrêter parce qu’elle ne digérait pas un ami qui passait me voir quotidiennement. Il s’appelle Toutane», a dit le mis en cause, S. Diallo. Il poursuit en réfutant l’usage d'armes blanches contre O. K. Ba.
« M. le président, si j’avais voulu le forcer, j’allais le faire sans utiliser une quelconque arme car ayant plus de force qu’elle. Mon chien également ne l’a jamais attaqué parce qu’il a été dressé à reconnaître tous ceux qui fréquentaient ma demeure.
Il ressort des éléments d’enquête des explications d’un témoin qui aurait croisé la victime après qu’elle a fui le domicile tard dans la nuit. D’après le procès-verbal d’enquête, la fille s’est agrippé à lui lorsqu’il l'a croisée en sanglotant avant de perdre connaissance.
La plaignante O. K. Ba qui n’avait pas de conseillers a réclamé 3 millions FCFA en titre de dommages-intérêts.
Dans son réquisitoire, le parquet a expliqué que le certificat médical établi, le 23 novembre, résulte sur des légions sexuelles anciennes et que celles-ci ne renseignent en rien qu’il y a acte sexuel imputé au mis en cause S. Diallo. Mieux, l’examen gynécologique n’a pas fait état de présence de spermatozoïdes dans le vagin de la victime. Pour le procureur, la dame peut avoir raison qu’il y a acte sexuel, mais selon les éléments réunis il n’y a pas de conjonction sexuelle. Le parquet relève ainsi le doute, mais approuve des violences et voies de faits entre les deux parties. Le ministère public a demandé de reconsidérer les faits en violences et voies de faits contre le prévenu et réclame 1 an d’emprisonnement ferme pour le délit.
La défense a pour sa part exposé des contradictions dans les propos de la victime qui a été consultée par un médecin spécialiste qui a produit un document attestant qu’elle n’avait aucun problème de traumatisme, idem pour l’absence de conjonction sexuelle. Elle a demandé un acquittement purement et simplement. Elle a également introduit une demande de liberté provisoire en faveur de son client S. Diallo mais la chambre l’a tout bonnement rejetée. L’affaire a été mise en délibéré au 16 mai prochain…
