Une affaire de viol collectif, de vol commis la nuit a déchiré une famille à Sindia, dans le département de Mbour. Les victimes toujours sous le choc trois ans après ce drame étaient à la barre de la Chambre criminelle du Tribunal de Mbour.
Dans la nuit du 9 au 10 septembre 2021, vers 3 heures du matin, des individus armés de machettes s’introduisent dans la maison de la dame Fatoumata Baldé, exercent une violence sur elle et lui volent 70 000 FCfa. Ils ne s’en arrêtent pas là. Ces malfrats vont ensuite faire subir à quatre filles des actes sexuels. R. Ba, R. Baldé, FC Ba et Adama B dormaient paisiblement quand ils furent réveillées par cette bande de malfaiteurs encagoulés. Elles ont eu de la peine à reconnaître leurs bourreaux.
Le seul à se présenter à la barre est Mbaye Sow, le jeune berger, à la démarche claudicante que les voisins des victimes ont cueilli dans une maison inachevée où il logeait.
Si à l’enquête préliminaire l’une des victimes C. Ba avait déclaré avoir vu Mbaye Sow, c’est tout le contraire qu’elle a servie à la barre, au point de faire douter plus d’un sur la participation de l’accusé dans les actes commis par la bande.
« Je dormais dans la maison inachevé où j’habitais avec Assane quand des gens nous ont réveillés. Assane s’est enfui. Je suis un berger et c’est dans la maison où je vis que je garde mes troupeaux » a déclaré l’accusé.
Le Procureur a requis l’acquittement pour l’accusé du fait de l’absence de preuves qu’il a participé au vol et au viol. L’affaire est mise en délibéré pour le 15 mai.
